PRIVACY AND COOKIES POLICY
BE SHAPING THE FUTURE SP. Z O.O.

This privacy and cookie policy describes the rules for the processing and protection of personal data obtained and processed in connection with the use of the website https://www.be-tse.pl/ (“Service”), both with reference to personal data of users of the Service that is collected directly from them, as well as data collected through cookies and similar technologies.

Be Shaping The Future collects and processes personal data in compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/ 46/WE (general regulation on data protection, hereinafter: “GDPR”), as well as the provisions of the Act of 10 May 2018 on the protection of personal data and implementing acts to this act. The provision of this information is in pursuance of the obligation set out in Article 13 of the RODO.

The administrator of personal data collected in connection with using the Website is Be Shaping The Future Sp. z o.o. with its seat in Warsaw, at the address: Al. Jana Pawła II 22, 00-133 Warsaw, NIP: 7831695942, REGON: 302331068, registered by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number: 0000453527 (hereinafter: “Administrator” or “Be Shaping The Future”).

Sources and scope of personal data collection

Be Shaping the Future collects personal data from the following sources and from the following extend:

  • directly from the data subjects by traditional correspondence, email or telephone using the contact details of Be Shaping The Future provided on the Website (in the form of email address and telephone number); in this regard, data such as the user’s name, email address, mailing address and telephone number are collected;
  • through automated tracking technologies, by means of which the data left by the user on the Website when visiting it is collected; in this regard, automatically acquired information about the user’s interaction with the Be Shaping The Future website is collected, using technologies such as cookies, weblogs, and www signaling devices and web tags. Specifically, this includes the information sent by the user’s web browser and data contained in system logs. This information may include data such as the date of visit to the Website and the time spent on the site, IP address (internet address informing about the computer, telephone, tablet or other device used by the user), browser type and version, location, data of the website visited immediately before entering the site.
  • directly from data subjects and by means of automated tracking technology, when visiting the profiles of Be Shaping The Future on the social networks LinkedIn and Twitter; in this regard, data such as comments, likes, and online identifiers are collected.

Purposes and legal basis for processing

Be Shaping The Future uses the collected personal data for the purpose for which they were collected, and in a broader scope only for the purposes provided for by law or for the purposes resulting from the legitimate interests pursued by the Administrator. In particular, Be Shaping The Future uses the collected personal data on the legal basis of its legitimate interest (Article 6(1)(f) of the RODO), in the pursuit of the purposes indicated below:

  • for the purpose of communication via e-mail or traditional correspondence (letter), in the case of answering questions concerning the business activity conducted by Be Shaping The Future – the Administrator’s legitimate interest consists in the necessity of answering the questions posed to Be Shaping The Future;
  • for the purpose of telephone communication, in case of contacting Be Shaping The Future in cases connected with the services provided by us – the Administrator’s legitimate interest in this case consists in the necessity of handling inquiries directed to Be Shaping The Future by phone;
  • for the purpose of maintaining profiles of Be Shaping The Future on social networking sites LinkedIn and Twitter, in particular in order to provide users of the sites with information about the activities and actions undertaken by Be Shaping The Future, including for promotional purposes, and about Be Shaping The Future’s products and services, as well as for statistical and analytical purposes – the Administrator’s legitimate interest in this case consists in promoting its own brand and improving the quality of the services provided, as well as in asserting and protecting against claims;
  • for statistical and analytical purposes (network traffic analysis) and to ensure safety within the Service – in this case, the Administrator’s legitimate interest consists in conducting analyses of the activity of the Service users and of their preferences in order to improve the functionality of the Service.

Cookies and other similar technologies

Cookies are IT data, in particular text files or pixels, stored in the users’ terminal equipment (computer, phone, tablet, etc.) while using websites, which can be read each time the user connects to the terminal equipment by Be Shaping The Future’s ICT system (so-called “own cookies”) or by third party ICT systems (so-called “third party cookies”). Cookies are used, among other things, to improve the quality of services provided through the websites and to remember user settings and preferences.

The use of cookies on the Website is not intended to identify users.

Some cookies used by Be Shaping The Future are deleted at the end of a web browser session, i.e. when the browser is closed (so-called session cookies). Other cookies are stored on the user’s terminal device and allow the browser to be recognized the next time the user visits the website (permanent).

Be Shaping The Future uses following types of cookies:

  • necessary cookies – files necessary to ensure efficient functioning of the Website;
  • functional cookies – cookies used to remember and adapt the Website to user choices, e.g., language preferences;
  • analytical cookies – files that allow obtaining analytical and statistical data related to the use of websites (such as number of visits and traffic sources on the Website).

Be Shaping The Future uses cookies based on user consent, except where cookies are necessary to ensure the proper functioning of the Service. Cookies that are not necessary to ensure the proper functioning of the Service remain blocked until the user consents to the use of cookies. During the User’s first visit to the Website, a message asking for consent to use cookies will be displayed. In this case, note that if the User does not agree to the placement of cookies, she/he will not be able to fully use all the features of the Website. The user can always resign from cookies, as well as define the conditions of using cookies by himself through the settings of his web browser. If the user does not make any changes to the browser’s settings regarding cookies, it means that they will be placed on the user’s terminal equipment and therefore Be Shaping The Future will store information in the terminal equipment and gain access to it.

Social App Widgets

The pages of the Service may contain plug-ins and other instruments provided by social networking services, such as LinkedIn, Twitter. Therefore, when displaying the Be Shaping The Future website, the user’s browser establishes a direct connection with the servers of the above-mentioned service providers, who thereby obtain information that the user’s browser has displayed the Be Shaping The Future website, even if the user does not have a profile with the given service provider or is not logged in to it.

Any personal data given by users through the designated social networking applications are subject to the privacy policies of the companies that provide the applications. Be Shaping The Future is not responsible for the processing of personal data by the social network providers. The principles of the processing of personal data by the individual providers of social networking applications, as well as the user’s rights in this regard and the possibility of making settings to ensure the protection of the user’s privacy, are described in the privacy policies of the individual providers:


User rights

The person whose data is processed as part of the Be Shaping The Future website has the following rights in relation to his/her personal data:

  • the right to access the data and receive a copy of it,
  • the right to correct the data,
  • the right to delete the data,
  • the right to limit the data processing,
  • the right to object to data processing,
  • the right to transfer the data,
  • the right to lodge a complaint with a supervisory authority.

In order to exercise the above rights, please contact the Administrator at the contact address indicated in this Privacy Policy in the point entitled “Contact with the personal data administrator”, providing in the application these informations that allows the verification of the user’s identity. In order to lodge a complaint with a supervisory authority (i.e. the President of the Personal Data Protection Office), please contact the supervisory authority.

Personal data security

The protection of data stored as part of the Be Shaping The Future website is carried out in accordance with the requirements of generally applicable laws in Poland and the European Union, and their storage takes place on secured servers intended for this purpose.

Be Shaping The Future has implemented and applies technical and organizational measures to ensure the protection of processed data appropriate to the threats and categories of data protected, in particular, protects data against unauthorized disclosure, removal by an unauthorized person, processing in violation of applicable law and change, loss, damage or destruction. In particular, Be Shaping The Future ensures that operations on personal data are carried out only by authorized employees and associates of the Controller. Be Shaping The Future takes all necessary measures so that also the entities cooperating with the Administrator provide the guarantee of applying adequate security measures whenever they process the personal data on behalf of the Administrator.

Term of processing of personal data

The term of processing of personal data depends on the purpose of processing. Be Shaping The Future processes personal data for the period necessary to achieve the purposes for which the data was collected, in accordance with applicable regulations and the accepted data retention policy.

Except as provided in Art. 21 (1) GDPR, in the case of processing the user’s personal data on the basis of the legitimate interest of Be Shaping The Future, personal data will be processed until the user objects to this processing.

Data recipients

Personal data is stored on Be Shaping The Future’s servers and is not disclosed to unaffiliated entities. Data may be shared with representatives of Be Group.

Be Shaping The Future may transfer personal data to the following categories of recipients:

  • service providers acting on behalf of the Administrator, such as hosting or IT service providers – in such cases Be Shaping The Future signs with the above-mentioned entities the relevant data processing agreements, in accordance with the requirements resulting from the GDPR, and verifies the reliability of processing entities,
  • entities, bodies or institutions authorized to obtain access to data on the basis of legal provisions (e.g. court, prosecutor’s office, police).


Data transfer to third-countries

Be Shaping The Future transfers personal data outside the European Economic Area only when it’s necessary and with an adequate level of protection. In particular, personal data may be transferred by Be Shaping The Future to third countries in connection with the Administrator’s use of instruments that store personal data on servers located in third countries. In this case, Be Shaping The Future will meet all the requirements resulting from the GDPR, in particular, it will apply the mechanisms of personal data protection required by the GDPR in the event of data transfer to third-countries, i.e. in particular:

  • will cooperate with processors of personal data in countries for which an adequate level of personal data protection has been decided by the European Commission;
  • use the model contractual clauses issued by the European Commission;
  • apply binding corporate rules approved by the competent supervisory authority.

Change of the Privacy Policy

The Privacy Policy is verified on an ongoing basis and updated if necessary.
